Terms and conditions
The terms that govern your use of the MyPath.Care website. By using this Site, you agree to them.
Welcome to MyPath.Care, a website operated by MYPATH CARE LLC ("MyPath.Care," "we," "us," or "our"). These Terms and Conditions (the "Terms") govern your access to and use of mypath.care (the "Site"), including any content, features, and forms made available through it. Please read them carefully — by visiting the Site or submitting information through it, you agree to be bound by these Terms.
Acceptance of these terms
By accessing or using the Site, you confirm that you can form a binding contract with MyPath.Care, that you accept these Terms, and that you agree to comply with them. If you are using the Site on behalf of a company or other organization, you represent that you have authority to bind that organization, and "you" refers to both you and that organization. If you do not agree to these Terms, please do not use the Site.
Scope of these terms
These Terms cover the MyPath.Care marketing website only. They do not govern access to or use of the MyPath.Care platform. The platform — including any handling of protected health information (PHI) within it — is governed by the separate written agreements we enter into with our customers, including subscription agreements and Business Associate Agreements where applicable. If there is any conflict between these Terms and a signed agreement between you and MyPath.Care, the signed agreement controls for the services it covers.
Use of the Site
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Site in any way that violates applicable law or regulation.
- Attempt to gain unauthorized access to the Site, its servers, or any connected systems, or probe, scan, or test their vulnerability without our written authorization.
- Interfere with the Site's operation — including by introducing malware, flooding, or any activity that disrupts or degrades the Site.
- Use bots, scrapers, or other automated means to access the Site or harvest information from it, except for standard search-engine indexing.
- Submit false or misleading information through our forms, or impersonate any person or organization.
- Frame or mirror the Site, or use it to build a competing product or service.
Demo requests and submissions
When you request a demo or contact us through the Site, you agree to provide accurate, current information and to update it if it changes. Submitting a request does not create a customer relationship or any obligation on either side — it simply lets us get in touch.
Please do not submit any protected health information (PHI) or other sensitive personal information through the Site's forms. The contact form is for business inquiries only. Information about patients and claims belongs in the MyPath.Care platform under a signed agreement, never in a website form.
Intellectual property
The Site and everything on it — including text, graphics, logos, icons, images, page designs, and software — are owned by MyPath.Care or its licensors and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to view and use the Site for your internal business purposes of evaluating MyPath.Care. No other rights are granted.
"MyPath.Care," the MyPath.Care logo, and product names such as Care Order, Care Circle, and Care Team are trademarks of MYPATH CARE LLC. You may not use them without our prior written permission, except to accurately refer to us.
Feedback
If you send us ideas, suggestions, or other feedback about the Site or our products, you agree we may use it without restriction or obligation to you. We appreciate it — feedback from people who live claims workflows every day is how the product gets better.
Third-party links and services
The Site may contain links to third-party websites and relies on third-party services to operate (for example, form protection and email delivery, as described in our Privacy Policy). We do not control third-party sites and are not responsible for their content, policies, or practices. Linking does not imply endorsement.
Disclaimers
The Site and its content are provided on an "as is" and "as available" basis, for general informational purposes only. Content on the Site is not medical, legal, or professional advice, and product descriptions do not constitute a warranty or a binding commitment to any particular feature or result.
To the fullest extent permitted by law, MyPath.Care disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, though we work hard to keep it secure and reliable.
Limitation of liability
To the fullest extent permitted by law, MyPath.Care and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption — arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of your use of the Site will not exceed one hundred U.S. dollars (US $100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Indemnification
You agree to indemnify and hold harmless MyPath.Care and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Site.
Privacy
Your use of the Site is also subject to our Privacy Policy, which explains what information we collect through the Site, how we use it, and the choices you have.
Termination
We may suspend or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms or to protect the Site and its users. Sections that by their nature should survive — including intellectual property, disclaimers, limitation of liability, and indemnification — survive any termination.
Governing law
These Terms and any dispute arising out of your use of the Site are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to their jurisdiction and venue. If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect.
Changes to these terms
We may update these Terms from time to time. When we do, we'll revise the "last updated" date above. Your continued use of the Site after changes take effect means you accept the updated Terms, so we encourage you to review this page periodically.
